A. Scope

This User Agreement, together with the Terms of Service (collectively referred to as the "User Agreement"), specifies the terms and conditions for using the services and products of "Hottel" , a product of Ommune IT Solutions Pvt Ltd ("Ommune").

Any individual ("User") who inquires about or purchases products or services from Hottel through its websites, mobile applications, sales representatives, offices, call centers, branch offices, franchisees, agents, or other channels (collectively known as "Sales Channels") agrees to be bound by this User Agreement. The websites and mobile applications of Hottel are collectively referred to as the "Website."

In this User Agreement, the User and Hottel are individually referred to as a "Party" and collectively as the "Parties."

The "Terms of Service" available on Hottel's website outline the terms and conditions applicable to the various services or products offered by Hottel. Users should review the relevant Terms of Service for the specific product or service they have booked, as these Terms of Service are binding.

B. Agreement between Client and "Hottel"

By accessing, using, navigating, or making reservations through Hottel.in, Users consent to comply with the terms and conditions of our platform. In the case of any breaches, "Hottel" and its parent company, Ommune IT Solutions Pvt Ltd, reserve the right to take appropriate legal measures.

By booking through our website, you acknowledge that Hottel operates as an intermediary platform. While we strive to deliver excellent services and charge a service fee for our efforts, we are not liable for actions taken by accommodation providers or other suppliers, including cancellations, changes, insolvency, or any other issues that may arise.

As a User, you are engaging the services provided by the accommodation provider. "Hottel" will not be responsible for any disruptions or alterations to your travel plans initiated by the accommodation provider or other service providers.

C. Payment Modes and Policies
C.1. Accepted Payment Methods

"Hottel" accepts the following payment methods for booking and purchasing services:

  • Credit/Debit Cards: Major credit and debit cards, including Visa, MasterCard, and others.

  • Net Banking: Payments can be made through various banks' online banking services.

  • UPI (Unified Payments Interface): Payments can be made via UPI apps like Google Pay, PhonePe, Paytm, etc.

  • Digital Wallets: Payments through digital wallets such as Paytm and PhonePe.

  • Bank Transfers: Direct bank transfers can be arranged upon request.

C.2. Payment Policies
  • Charges and Fees: All charges, including service fees, taxes, and surcharges, will be clearly outlined in the booking confirmation or invoice. The User is responsible for these charges.

  • Payment Security: Hottel employs secure payment gateways and encryption technologies to ensure the safety and confidentiality of payment transactions.

  • Transaction Confirmation: Upon successful payment, a confirmation receipt will be sent to the User via email or SMS. It is the User's responsibility to verify the accuracy of the payment details and notify Hottel of any discrepancies immediately.

D. Eligible to Use

The User must be at least 18 years of age and have the legal authority to enter into an agreement to become a User and utilize the services of "Hottel".

Minors under the age of 18 are not permitted to register as Users of the Website or engage in transactions. If a minor wishes to use or transact on the Website, such use or transaction must be conducted by a legal guardian or parent.

Hottel reserves the right to terminate membership or block access to the Website if it is discovered that the User is a minor or has provided false information about their age at the time of registration.

By using the Website, engaging with any Sales Channels, or procuring the services of Hottel, Users agree to this User Agreement as a binding document governing their dealings and transactions with Hottel. If you disagree with any part of this Agreement, you should not use Hottel's services or access the Sales Channels.

E. Website Handling
E.1. Acceptance of Terms

By accessing and using the Website, you agree to comply with and be bound by the terms and conditions set forth in this agreement. If you do not agree with these terms, please refrain from using the Website.

E.3. Intellectual Property
  • Content Ownership: All content, including text, graphics, logos, images, and software on the Website, is the property of "Hottel" or its licensors and is protected by intellectual property laws.

  • Restrictions: You may not copy, reproduce, distribute, or create derivative works from the content on the Website without prior written permission from "Hottel".

E.4. User Conduct

Prohibited activities include but are not limited to distributing malware, engaging in spamming, or attempting to gain unauthorized access to the Website's systems.

F. Amendments to this Agreement

"Hottel" reserves the right to modify or update this User Agreement at any time without prior notice. Changes will be effective immediately upon posting on the Website. Continued use of the Website constitutes acceptance of the revised terms.

G. Governing Law

This User Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising under this User Agreement shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, where Ommune IT Solutions Private Limited is headquartered.
